Is Alito fit for the Third Circuit Court?

Ted Kennedy opened his (frequently used) pie-hole to announce that he would vote no to the nomination Samuel Alito because he is "not committed to equal justice under law".

Democrats on the Committee have called him unethical and dangerous; insinuated he was a closet racist and sexist; and frequently claimed that he often acts as the "crushing hand of fate" to unprivileged plaintiffs.

The question is, if Sam Alito is not confirmed to the Supreme Court, should the nutjobs who level these charges be content with him keeping his seat on the Third Circuit Court? It seems to me if he is really so bad, the only real option is for Kennedy to lead the push to have him impeached.

Or maybe Kennedy doesn't mean what he says.
